Booking and hiring conditions - For The Lawns and Lakes Touring and Camping Pitches and On-Site Touring Caravan and Awning Hire
These booking and hiring conditions (the "Conditions") apply to all bookings made in respect of The Lawns and Lakes Camping and Caravanning Site. The Conditions form part of a contract between the person making the booking ("You"/"Your") and N D & T D Pickett the owner of the Park (the "Company"). For the purpose of these conditions; (i) the "Booking Deposit" is the amount payable under Paragraph 1(a) or 1(b) (or deemed to be paid under paragraph 1(e)); and (iii) the "Balance of the Total Charge" is the amount by which the Total Hire Charge exceed the Booking Deposit.
When making a booking, You guarantee that You have the authority to accept, and do accept, on behalf of Your Party the terms of these conditions. Your contract with the Company will exist as soon as the Company issues to you its booking confirmation/receipt of deposit. This contract is made on the terms of these Conditions. These Conditions are governed by English law and You can bring legal proceedings in respect of them in the English courts. If you live in Scotland You can bring proceedings in either the Scottish and English courts and if you live in Northern Ireland You can bring proceedings in either the Northern Irish or English courts. The cancellation conditions also apply to off site bookings of Entertainments, meals etc.
1(a) Pitches for touring caravans, motorhomes and tents - subject to paragraph 1(c) and 1(e), no booking will be accepted unless accompanied by a Booking Deposit of £75 per week or part week, per pitch. Pitches are priced on 2 adults and 2 children (children are from 0-16years - 16 years and above will be classed as an adult).
Where the Total Hire Charge is lower than the Booking Deposit, the full amount of the Total Hire Charge is due at the time of booking.
(b) You may, if you wish, pay the Total Hire Charge at the time of Your booking (instead of paying only the Booking Deposit). If you only pay the Booking Deposit at the time of Your booking, THE BALANCE OF THE TOTAL HIRE CHARGE MUST BE PAID AT LEAST 21 DAYS BEFORE THE COMMENCEMENT OF THE HIRE PERIOD. In the event that the payment is not received by such date, You will be deemed to have cancelled Your booking at the commencement of the 36 day period referred to in this paragraph 1(c) and the provisions on paragraph 3 and 4 will apply accordingly. Where a booking is made less than 36 days before the commencement of the hire period we will only accept the booking if You pay the Total Hire Charge.
(c) Where bookings are taken from residents outside of the United Kingdom, payments will only be accepted by recognized Credit/Debit Cards.
(d) If you opt to pay the Total Hire Charge at the time of Your booking, You will be deemed to have paid the Booking Deposit calculated in accordance with paragraph 1(a) and 1(b).
(e) No refunds given for late arrivals, early departures or inclement weather.
2 (a) The Company reserves the right to refuse bookings made by larger parties or celebration parties which it believes may spoil the quiet enjoyment of the Parks by other users or damage the reputation of the Company or the Parks.
2(b) The Company reserves the right to refuse bookings at their discretion - deposit and/or monies paid will be refunded immediately and the contract will be voided.
3 In the event that you cancel Your booking (whether before, on or after the commencement of the 36 day period referred to in paragraph 1(b), the Booking Deposit will not be refunded to You but will be used to meet the expenses the Company incurs in trying to re-let the pitch. Notice of cancellation must be sent in writing to The Lawns and Lakes Camping and Caravanning Site (You are advised to use registered or recorded delivery).
4 In the event that You cancel Your booking under paragraph 3 above and Your booking is cancelled on or after the commencement of the 36 day period referred to in paragraph 1(b)(or if You are deemed to have cancelled Your booking in accordance with paragraph 1(b), You will be required to pay a percentage of the Balance of the Total Hire Charge in respect of the original booking period. The percentage of the Balance of the Total Hire Charge payable on cancellation is as follows:-

If You have already paid the Balance of Total Hire Charge in accordance with paragraph 1(b) or have paid the whole of the Total Hire Charge at the time of Your booking, the Company will refund to You the percentage of the Balance of the Total Hire Charge not payable by You under the above table.
5 In the event that You cancel Your booking under paragraph 3 above and Your booking is cancelled before the commencement of the 36 day period referred to in paragraph 1(b), You will not be required to pay the Balance of the Total Hire Charge in accordance with paragraph 1(b) or have paid the whole of the Total Hire Charge at the time of Your booking, the Company will refund to You the Balance of the Total Hire Charge.
6 Subject to paragraph 7 below, in the event that You cancel any booking as a result of death or serious illness of a member of Your party as detailed on the booking form, or the redundancy of You or Your spouse or partner, and where suitable evidence is produced (e.g. letter or certificate), You shall not be required to pay the Balance of the Total Hire Charge. If You have already paid the Balance of the Total Hire Charge in accordance with paragraph 1(b) or have paid the whole of the Total Hire Charges at the time of Your booking, the Company will refund to You the Balance for the Total Hire Charge. The Booking Deposit shall not, however, be refundable in these circumstances.
7 The Balance of the Total Hire Charge shall not be refundable to You in the circumstances described in paragraph 6 above in the event that a booking is cancelled as a result of pre-existing medical condition or injury of a member of Your party (being a medical condition or injury which exists at the time of booking).
8 Although the Company will do everything possible to avoid doing so, in the event that we can no longer offer the pitch You have booked, or due to exceptional circumstances has to cancel Your booking, the following options are available. An alternative holiday, if the holiday is lower in price than that of the original, we will refund the difference, if the cost is higher than, we will ask you to pay the difference. Or a full refund. (such figure will not exceed the Total hire Charge). The Company will have no further liability to You for any other costs or expenses arising as a result of such cancellation. In the event of lockdown due to Covid Restrictions your booking will be transferred to alternative date of your choosing and all Deposits or Total Hire Charge will be transferred, if the holiday is lower in price than that of the original, we will refund the difference, if the cost is higher than, we will ask you to pay the difference.
9 We will not take responsibility or pay compensation if we cancel or change your booking in any way because of events beyond our control. This means any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include fire, flood, explosion, storm, adverse weather conditions, criminal damage, riots or civil strife, industrial action, nuclear or natural disaster, epidemics or pandemics, war or threat of war, terrorist activity.
10 Pitches for touring caravans and tents are available from 1pm on the day of arrival and must be vacated by 11.00am on the day of departure or by such later time as may be booked by You (if available to do so).
11 An administration charge of £15 per booking will be made for alterations to the booking, including alterations to pitch type, additional services and extra dates and for offers not claimed at the time of booking. No alteration can be made under this paragraph and paragraph 10 after the commencement of the 21day period referred to in paragraph 1(b). This also applies to amended third party bookings or additional items, deposits, services added to third party bookings. Deposits for meals and gala night ticketed events cannot be refunded once inside the 21 day period. Breakfast deposits can only be redeemed against the full price of the breakfast on the day booked.
12 Touring pitches must be kept in a clean and tidy condition. You are responsible for the cost of repair or replacement for any breakages or other damages caused during Your occupation. If you fail to leave a touring pitch in a clean and tidy condition, the Company reserves the right to charge You an additional cleaning charge for any cleaning which is additional to the standard cleaning that the Company usually carries out between lettings of a touring pitch.

13(a) All users of the Park are responsible for the safekeeping of any personal possessions or other physical property which they bring onto the Park and are required, at all times when they are on the Park, to exercise due care and attention to protect their own personal safety and wellbeing, children under the age of 16 are required to parental guidance and attendance at all times due to the open water courses on site.
(b) The Company accepts liability for You for personal injury or death caused by the negligence of the Company or its employees and officers (acting within the course of their employment or duties and scope of their authority).
(c) The Company's liability for any loss of or damage to any personal possessions or other physical property caused by the negligence of the Company or its employees of officers acting within the course of their employment or duties and scope of their authority shall be limited to the repair, replacement or reinstatement value of such personal possessions or physical property (whichever is the lowest). You are responsible for your own surge protection within your caravan, motorhome, RV or tent within the pitch, you are responsible for having the required equipment to prevent a surge from damaging your equipment, the Company will not be liable for any damages or losses.
(d) Subject to (b) and (c) above, if we fail to comply with these Conditions, we are responsible for loss or damage You suffer that is a foreseeable result of our breaking this contract of our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract making a booking. (d) In no circumstances shall the Company have any liability to You or any other user of the Park for any damage, loss or injury caused by Your negligent acts or omissions or those of any other user of the Park.
14(a) You undertake on behalf of Yourself and all members on Your party to observe the Park rules as displayed at the Park from time to time.
(b) Parking; Touring caravans, Motorhomes and tents - one car per pitch permitted.
(c) Occupancy; Touring caravans, Motorhomes and tents pitches - maximum occupancy is 6 people per pitch.
15 Dogs are permitted on Touring Caravan, Motorhome and tent pitches. Certain breeds of dog are not permitted in order to maintain safety and wellbeing of all of our guests. These are; Pit Bull Terrier, Japanese Tosa, Dogo Argentino, Fila Brazilliero or a cross breed of any of the breeds shown. If you are in doubt about whether your dog will be permitted, please contact the Park prior to booking for confirmation. Dogs must be on a lead at all times and must not be left unattended. The Company reserves the right to require anyone who brings a dog onto the Park (whether or not on the breeds referred to above) which is considered a nuisance, or is affecting the comfort of other guests, to remove it from the Park.
16 All prices quoted by The Lawns and Lakes Camping and Caravanning Site are inclusive of VAT where applicable at the rate in force at the time of publication. The right is reserved to vary the inclusive cost should VAT rate alter.
17 To ensure the quiet enjoyment of the Park at night, parents and guardians and children are requested to uphold the sites policy of quiet by 10pm and all quiet by 11pm.
18 The Company or its representatives reserves the right to require You, any member of Your party or other users of the Park to leave the Park where such persons breach the terms set out in these Conditions or breach any of the parks' rules referred to in paragraph 13(a)
19 The Company or its representatives reserve the right to refuse admission to the Park. In such circumstances, the Company may, in its sole discretion, offer You a refund of all or part of the Total Hire Charge.
20 All information in brochures and/or our website about services and facilities at the Park was accurate at the time of publication. The Company reserves the right to vary the services and facilities available at the Park from time to time depending on demand, availability of third party suppliers, health and safety reasons or circumstances beyond the Company's' reasonable control. We will open the services and facilities only if our own risk assessments and the Law tells us we can do so safely. In the event that they close at short notice, you are still receiving the holiday You booked for a Touring and Camping Pitch, we have not promised these facilities will be open and you will not be entitled to cancel or to receive any compensation in the event of closure.
21 You are advised to take out an appropriate travel insurance policy at the time of booking from a reputable insurance provider.
22 Any customer data supplied by You about You or Your party will be used in accordance with the data protection laws.
23 All special offers, discounts and short breaks are subject to availability, only one special offer or discount per booking.
24 This contract is between you and us. No other persons shall have any rights to enforce any of its terms.
25 Safety:
On Site Touring Caravan Rental Conditions
In addition to the above Terms and Conditions the following also apply:-
We reserve the right to refuse caravan hire without stating our reasons.
Where adverse weather conditions, or any other factors outside of our control, are present or forecast, we reserve the right to refuse caravan hire or to impose restrictions on its use. We also reserve the right not to supply or erect an awning.
An adult over the age of 25years must be using, and be responsible for the caravan and awning.
The hirer must inform us, as soon as is practical, of any breakdown, accident, loss or damage to the caravan.
The hirer is responsible for any uninsured loss, destruction or damage to the caravan including but not limited to negligence or willful damage.
In the interests of safety and other hirers of the caravan, we adopt a NO SMOKING and NO PETS policy in both the caravan and the awning (if fitted).
No candles or other naked flames are to be lit in the caravan or awning (fitted caravan equipment is not included in this).
No liability will be accepted for any shortages, or failure of equipment should it occur, or for any loss, accident or injury however caused.
Except for the services and awning supplied by ourselves, nothing can be stuck to, or attached to, any part of the caravan, inside or out.
Bookings will be confirmed by email, along with Terms and Conditions. The caravan will not be reserved until the completed payments are made in full.
All bookings must be accompanied by a deposit payment of 50% of the total hire fee. Once the caravan is reserved, this payment is NON REFUNDABLE under any circumstances (including Covid-19 consequences).
The balance of the total cost must be paid no later than 3 weeks prior to the start of hire. Should the balance not be paid on time, the caravan will be released for rehiring.
Where a booking is made less than 3 weeks prior to the hire period, the deposit and balancing payment must be made at the time of the booking.
A £200 security deposit will be required upon arrival payable by card payment/bank transfer prior to being handed the keys to the caravan. This will be fully refunded after the hire if the caravan is returned clean, complete and in good condition, with chemical toilet emptied and cleaned. Damage, shortages or an excessively dirty caravan and/or awning will result in the forfeit of some or all of the deposit at our discretion. Failure to empty and clean our the toilet will incur a charge of £50.00.
An itemized list will be issued with the keys of all the contents of the Caravan and Awning, this should be checked upon arrival. Any missing or damaged items are to be reported within 24hours otherwise this will be deducted against your security deposit.
The Caravan will be available from 1.00pm onwards on the start day and the keys must be returned to us no later than 10.00am on the finish day, unless by prior arrangement to the contrary. Late return will result in a charge of £20.00 per hour (or part thereof).
Cancellation more than 3 weeks prior to the commencement of the hire will forfeit the deposit as stated above

However, should the caravan be subsequently rehired for the cancelled period we will refund the balancing payment paid (but excluding the deposit)
It is the hirers responsibility to arrange cancellation insurance.
